Cubex Digital is pleased to provide you with the following Terms & Conditions, which apply to all services we provide.
By engaging Cubex Digital, you agree to the terms outlined below.
1. Cubex Digital’s Role
1.1 The Services
Cubex Digital will provide the services as described in the agreed proposal, quotation, or service agreement.
As a project develops, the scope of work may change. If this occurs, Cubex Digital will discuss the changes with you as soon as possible and agree on any necessary adjustments to the scope, timeline, or pricing before proceeding.
1.2 Client Responsibilities & Information
To ensure successful delivery, we work collaboratively with our clients.
You agree to:
Provide accurate and complete information
Respond to requests in a timely manner
Supply required content, materials, and approvals
Cubex Digital will assume that all information provided by you is accurate and complete unless otherwise stated.
Delays caused by failure to provide necessary information may impact project timelines.
1.3 Incidentals & External Costs
Any third-party expenses such as:
Printing
Courier services
Stock images
Paid plugins
Hosting services
Advertising budgets
External production services
will be charged separately to the client unless explicitly stated otherwise in the quotation.
1.4 Force Majeure
Cubex Digital shall not be liable for any delay or failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet failures, power outages, or third-party service interruptions.
2. Payment Terms
2.1 Payment Conditions
Payments must be made via bank transfer or other agreed payment methods.
Projects may require an advance deposit before work begins.
Final deliverables remain the property of Cubex Digital until full payment is received.
Late payments may result in project suspension.
Cubex Digital reserves the right to charge late payment fees where applicable.
2.2 Additional or Specialist Services
Additional services such as:
Photography
Videography
Influencer marketing
Advanced development work
Paid ad management budgets
will be quoted separately. Third-party costs will be passed directly to the client.
3. Content & Intellectual Property
3.1 Client Content Responsibility
It is your responsibility to provide all necessary content related to your business and marketing objectives.
Cubex Digital is not responsible for:
Errors in client-supplied content
Copyright violations in materials provided by the client
Legal compliance of claims made in client content
Any revisions required due to incorrect content may be charged at standard rates.
All materials must be supplied in suitable digital format unless otherwise agreed.
3.2 Ownership
Upon full payment:
The final approved work will belong to the client.
Cubex Digital retains the right to display completed work in its portfolio unless otherwise agreed in writing.
4. Confidentiality
Cubex Digital will keep your information confidential except:
Where disclosure is required by law
Where information is already public
Where disclosure is necessary to subcontractors, affiliates, or service providers involved in completing your project
All third parties engaged by Cubex Digital are expected to maintain confidentiality standards.
5. Limitation of Liability
Cubex Digital’s total liability arising from any contract or service shall not exceed the total amount paid by you for the specific service.
We shall not be liable for:
Loss of profits
Loss of revenue
Loss of business
Loss of goodwill
Indirect or consequential damages
6. No Refund Policy
All payments made to Cubex Digital are final.
Due to the nature of digital services, marketing strategies, and custom development work:
Deposits are non-refundable.
Payments for completed work are non-refundable.
Once a project has commenced, no refunds will be issued.
We will, however, work with clients to resolve any service-related concerns professionally.
7. Termination
Either party may terminate services in writing.
If termination occurs:
The client must pay for all work completed up to the termination date.
Any outstanding invoices become immediately payable.
8. Variation
These Terms & Conditions may be updated or modified by written agreement between Cubex Digital and the client.
Any variations will not affect previously accrued rights or obligations unless expressly agreed.
9. Governing Law
These Terms & Conditions shall be governed in accordance with the applicable laws of the jurisdiction in which Cubex Digital operates.
